Terms of Service

These Terms of Service ("Terms", "Agreement") set out the conditions on which Sholokhov Mikhail Andreevich (Sole Trader) ("Provider", "we", "us", "our") offers and you ("Customer", "you") may use the PicSwipe mobile application and related pages on typecode.app (the "App" and, together with legal pages on typecode.app, the "Service").

By downloading, installing, subscribing, or otherwise using the Service in a way that shows you intend to be bound, you accept these Terms in full. If you do not agree, do not use the Service.

1. Provider

The Provider is:

Typecode and PicSwipe are product names; the contracting party is the Sole Trader above.

2. The Service

PicSwipe is a utility that lets you browse your photo library on your device, swipe to keep or mark items for deletion, and permanently delete items you confirm from the in-app Trash. Optional PicSwipe Pro features are offered via auto-renewable subscription through the Apple App Store.

Photos are processed on your device. We do not operate a cloud backup of your photo library for core app features.

3. Eligibility

You must be able to form a binding contract under applicable law. If you are under the age of majority in your country, you may use the Service only with parental or guardian consent where required.

4. Licence

Subject to these Terms and your compliance with them, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the App on Apple devices you own or control, solely for personal, non-commercial use (unless we agree otherwise in writing).

You may not: reverse engineer the App except as permitted by law; copy, modify, or distribute the App; use the App to violate law or third-party rights; or circumvent subscription or security measures.

5. Subscriptions (PicSwipe Pro)

  • Subscriptions are sold through Apple In-App Purchase. Payment, renewal, and cancellation are handled by Apple under Apple’s terms.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Manage or cancel in Settings → Apple ID → Subscriptions on your device.
  • Prices and trial periods (if any) are shown in the App at purchase. Apple may change displayed pricing in your storefront.
  • Restore Purchases is available in the App for use on a device signed in with the same Apple ID.
  • Refunds for App Store purchases are governed by Apple’s refund policies; we do not control Apple’s billing decisions.

6. Photo deletion and your responsibility

  • Marking photos for deletion in PicSwipe queues them in an in-app Trash until you confirm permanent deletion.
  • Permanent deletion is irreversible (subject to iOS, iCloud, and “Recently Deleted” behaviour). You are solely responsible for reviewing items before confirming deletion.
  • We are not liable for loss of photos, videos, or other content you choose to delete, or for failure to delete due to system restrictions, sync delays, or revoked permissions.

7. Acceptable use

You agree not to use the Service to infringe intellectual property, harass others, distribute malware, or violate applicable law. We may suspend or restrict access if you materially breach these Terms, if required by law, or to protect security or integrity of the Service.

8. Intellectual property

The App, website content, trademarks, and underlying software are owned by the Provider or licensors. Except for the limited licence in Section 4, no rights are granted to you.

9. Third parties

The Service relies on Apple (distribution, payments, Photo Library APIs) and RevenueCat (subscriptions). Their terms and privacy policies apply to their services. We are not responsible for third-party websites linked from the Service.

10. Disclaimer of warranties

To the maximum extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or that deletion will always succeed (e.g. protected assets, iCloud sync, or OS errors).

11. Limitation of liability

To the maximum extent permitted by applicable law:

  • The Provider shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
  • Our aggregate liability arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months before the claim, or (b) USD 50, except where such limitation is prohibited by mandatory law.

Nothing in these Terms excludes liability that cannot be excluded under applicable consumer protection law.

12. Indemnity

You agree to indemnify and hold harmless the Provider from claims arising from your misuse of the Service, your content, or your violation of these Terms or applicable law, except to the extent caused by our wilful misconduct.

13. Suspension and termination

You may stop using the Service at any time by uninstalling the App and cancelling subscriptions. We may suspend or terminate access for material breach or as required by law. Provisions that by nature should survive (including Sections 6, 10–11, and 14) survive termination.

14. Privacy

Our Privacy Policy explains how we process personal data. By using the Service, you acknowledge that policy.

15. Changes to these Terms

We may amend these Terms. The "Last updated" date will change when we do. Continued use after posting may constitute acceptance where permitted by law. Your statutory rights as a consumer remain unaffected.

16. Dispute resolution; governing law; language

These Terms are governed by the laws of the Republic of Armenia, without regard to conflict-of-law rules that would refer to another jurisdiction, except that mandatory consumer protections of the country where you habitually reside may apply where such rules cannot be contractually waived.

The Parties will endeavour to resolve disputes in good faith through negotiation before commencing formal proceedings. Subject to mandatory law, the courts of competent jurisdiction in Yerevan, Armenia, shall have jurisdiction, or, where mandatory law requires, the courts of your place of residence may have jurisdiction for consumer claims.

The English language version of these Terms prevails. Translations, if any, are for convenience only.
